Terms of Service

1. Acceptance of Terms

By accessing or using Notiee ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

Notiee is a study platform that uses AI as an assistant, not as a content generator. The platform provides:

• User-editable notes and flashcards with full control over content
• AI-assisted content summarization and question generation (always editable by user)
• Voice-to-text transcription services
• Organization of all study materials in one place
• Collaboration and sharing features
• Data synchronization across devices

3. User Accounts and Registration

Account Requirements

To use certain features of Notiee, you must create an account. You must be at least 13 years old to create an account. Users between 13-17 years old must have parental or guardian consent to use our Service.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload content that infringes intellectual property rights or contains malware
• Engage in harassment, abuse, or any form of harmful behavior toward other users
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools or bots to access the Service without permission
• Distribute spam, unsolicited communications, or malicious content
• Reverse engineer, decompile, or attempt to extract our source code

5. AI Services and Content

AI as an Assistant

Our AI features are designed to assist, not replace, your learning process. AI generates suggestions and helps with organization, but you always maintain full control and editing rights over your content. The goal is to save you time, not to think for you.

AI-Generated Content

When AI generates content based on your input, it creates suggestions that you can edit, modify, or reject. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or biases. You are responsible for reviewing and verifying any AI-generated content before using it for important purposes.

Processing by Third-Party AI Providers

For the AI features to work, the content you use them with (messages, notes, files, recordings, and materials for tests and study plans) is sent for processing to third-party AI service providers. These providers act as our processors and may use the content only to return the result to you. Content is sent only at the moment you use an AI feature.

We do not use your content to train AI models and we do not sell it. The specific providers and details of the processing are listed in our Privacy Policy. You can delete your content or your whole account at any time in Settings.

When you sign up, you agree to these Terms including this processing. Without it we cannot provide the AI features the Service is built on.

6. Subscription and Payment Terms

Subscription Plans

Notiee offers a free plan and the paid plans Plus and Super, billed monthly or per semester (6 months). The free plan includes the features that work without AI. Plus and Super include AI features within a monthly AI limit and a monthly number of hours of AI transcription of recordings (Plus 10 h, Super 60 h); live on-device transcription has no limit. Limits refill once a month, also on semester billing, and unused amounts don't carry over. Figures on how many AI tests, lessons or podcasts a limit covers are approximate — actual use depends on the length of the materials and outputs.

After using up the monthly AI limit, Plus and Super subscribers can buy a one-time AI refill (at most twice a month); a refill doesn't expire. A new account gets a one-time 7-day Premium trial: selected AI features in limited amounts (for example 3 AI tests, 3 AI flashcard sets, 1 hour of AI transcription). When the trial ends the free plan stays — nothing is charged and nothing renews automatically.

Paid subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before it ends. Cancelling stops future renewals; the plan stays active until the end of the paid period.

Where You Pay

On the web, payments are processed by LemonSqueezy and can be managed or cancelled in Settings → Billing. In the iOS app, payment is charged to your Apple ID and the subscription is managed in your App Store account settings; in the Android app, payment is charged to your Google Play account and managed in Google Play → Payments & subscriptions. Purchases made through the App Store or Google Play are also subject to Apple's or Google's terms.

Payment and Refunds

Payment is due at the beginning of each billing period. Refunds for web purchases may be provided at our discretion for unused portions of prepaid subscriptions. Refunds for App Store and Google Play purchases are handled by Apple or Google under their refund policies. Used AI limit, transcription hours and used AI refills are not refundable.

Price Changes

We reserve the right to change our pricing with 30 days advance notice. Price changes will not affect your current billing period but will apply to subsequent renewals.

7. Intellectual Property Rights

Your Content

You retain ownership of all content you create, upload, or store using our Service. By using Notiee, you grant us a limited, non-exclusive license to process, store, and display your content solely to provide our services to you.

Our Intellectual Property

Notiee and all related technology, including our AI models, algorithms, software, and design elements, are owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works of our platform without explicit permission.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to our privacy practices as described in our Privacy Policy.

9. Service Availability and Modifications

We strive to maintain high service availability but cannot guarantee uninterrupted access. We may temporarily suspend or restrict access for maintenance, updates, or security reasons.

We reserve the right to modify, update, or discontinue features of our Service at any time. We will provide reasonable notice of significant changes that may affect your use of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Notiee and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Notiee, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

Termination by You

You may terminate your account at any time by deleting it through your account settings or by contacting us. Upon termination, your access to the Service will cease, and we will delete your data according to our data retention policy.

Termination by Us

We may suspend or terminate your account for violation of these Terms, illegal activity, or other conduct that may harm our Service or other users. We will provide reasonable notice unless immediate termination is necessary for security or legal reasons.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Czech Republic without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the Arbitration Court attached to the Economic Chamber of the Czech Republic and Agricultural Chamber of the Czech Republic.

You may opt out of arbitration by notifying us within 30 days of account creation. Class action lawsuits and jury trials are waived for all disputes subject to arbitration.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will notify you of material changes via email or through our platform. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.

15. Miscellaneous

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Notiee regarding your use of the Service.
